Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of doctorwebsite.com and related services (collectively, the “Services”) provided by Better Wiki LLC, a Delaware limited liability company, doing business as Doctor Website (“Doctor Website,” “we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms.

If you are using the Services on behalf of a business, you represent that you have authority to bind that business to these Terms.

1) Operating area

United States & Canada. We primarily serve businesses located in the United States and Canada.
Other regions (case-by-case). We may accept clients outside the U.S. and Canada only on a case-by-case basis, at our sole discretion, if we determine the business is a good fit (including operational, legal, and platform-policy considerations).

2) Scope of Services

Doctor Website provides local SEO and digital marketing services which may include (depending on your plan, proposal, or statement of work (“SOW”)):

  • Local SEO strategy, on-page optimization, technical recommendations
  • Google Business Profile support and local listings/citations management
  • Website consulting and conversion optimization guidance
  • Paid advertising management and/or consulting (Google Ads, Meta/Facebook/Instagram, LinkedIn, Reddit)
  • Reporting and analytics setup, dashboards, and performance reviews

No guarantee of results. Rankings, traffic, leads, and ad performance depend on many factors outside our control. We do not guarantee specific outcomes.

3) Plans, proposals, and statements of work

If you purchase Services, the details (deliverables, timelines, fees, payment schedule, and scope) may be set out in an SOW, order form, or proposal. If there is a conflict between these Terms and an SOW, the SOW controls only for that engagement.

Work requested outside the agreed scope may require additional fees and written approval.

4) Client responsibilities

You agree to:

  • Provide timely access to required accounts and assets (e.g., website CMS, Google Business Profile, Google Ads, Meta Business Manager, analytics tools)
  • Provide accurate business information and truthful claims for ads/landing pages
  • Review deliverables and provide approvals/feedback within reasonable timeframes
  • Maintain backups of your website and data (unless we explicitly agree in writing to manage backups)

Delays caused by missing access or approvals may affect timelines and outcomes.

5) Advertising, marketing, and lead generation

5.1 Our marketing channels

We may market our Services using:

  • Google Ads
  • Meta (Facebook/Instagram)
  • LinkedIn Ads
  • Reddit Ads
  • Email marketing
  • Organic social media, including YouTube

5.2 Lead generation and consent to contact

When you submit your information through our website, forms, landing pages, or ads, you consent to us contacting you about our Services, including by email, and (where applicable) by phone/text using the details you provided.

5.3 No platform affiliation

Doctor Website and Better Wiki LLC are not endorsed by, affiliated with, or sponsored by Google, Meta, LinkedIn, or Reddit. Trademarks and logos belong to their respective owners.

6) Tracking technologies and interest-based advertising

6.1 Cookies, pixels, and tags

We may use cookies, pixels, tags, and similar technologies to:

  • Operate and secure our website
  • Understand site usage and improve performance
  • Measure marketing and ad campaign effectiveness
  • Deliver interest-based advertising and remarketing

6.2 Third-party partners

These technologies may be provided by third parties (including Google, Meta, LinkedIn, and Reddit). These partners may collect or receive information about your activity over time and across different sites/apps to personalize ads and measure performance.

6.3 Your choices

You can control cookies via your browser settings and may be able to limit interest-based ads through platform settings (e.g., Google Ad Settings, Meta Ad Preferences, LinkedIn Ad Preferences) and other opt-out tools made available by industry groups.

7) Email list and communications

7.1 Email signup

If you join our email list, request a free audit, download a resource, or subscribe for updates, we may send you:

  • The content you requested, and
  • Related messages about our Services and offers

7.2 Unsubscribe

You can unsubscribe at any time using the link in our emails. Unsubscribing from marketing emails does not affect non-marketing messages (e.g., confirmations, billing notices, security messages).

8) Testimonials and case studies

Testimonials, examples, and case studies are for illustrative purposes only. Results vary and depend on factors such as competition, budget, starting conditions, market demand, and implementation.

9) HIPAA and medical practices

Doctor Website is not a healthcare provider and does not provide medical advice. If you are a healthcare provider or medical practice:

9.1 Do not send PHI by default

You agree not to send Protected Health Information (“PHI”) to us through email, chat, SMS, website forms, or shared documents unless we have expressly agreed in writing and implemented appropriate safeguards.

9.2 Business Associate Agreement (BAA)

If our Services require creating, receiving, maintaining, or transmitting PHI on your behalf, HIPAA may require a Business Associate Agreement (“BAA”). We will only handle PHI after a BAA is fully executed and any required security measures are in place. If a BAA is required and not executed, we may refuse or limit work involving PHI.

9.3 Tracking/marketing tools and compliance

You are responsible for ensuring your use of tracking pixels, remarketing, call tracking, CRMs, and landing pages complies with HIPAA and applicable healthcare advertising rules, unless you have explicitly contracted us to provide compliance-specific services in writing.

10) Payments, billing, and ad spend

10.1 Fees and billing

Fees and billing terms are stated in your invoice or SOW. Unless stated otherwise, invoices are due upon receipt. Late payments may result in paused work and/or withheld deliverables until accounts are current.

10.2 Ad spend is separate

Media spend paid to ad platforms (e.g., Google/Meta/LinkedIn/Reddit) is separate from our service fees unless explicitly stated. You are responsible for ad spend and any related platform fees.

11) Refunds and cancellations

Unless your SOW states otherwise:

  • Service fees are non-refundable once work has started
  • You may cancel ongoing services by providing written notice to [support] @ doctorwebsite.com (remove spaces and brackets)
  • Any unpaid amounts for work performed through the cancellation effective date remain due

12) Intellectual property

12.1 Our materials

We retain all rights to our methodologies, templates, tools, processes, and know-how (“Doctor Website IP”). You receive a limited, non-exclusive, non-transferable license to use paid deliverables for your internal business purposes.

12.2 Your materials

You retain ownership of your trademarks, logos, and content (“Client Materials”). You grant us a limited license to use Client Materials solely to perform the Services.

12.3 Third-party tools

The Services may involve third-party software or platforms (plugins, hosting, analytics, call tracking, etc.). Those are governed by their own terms, and you are responsible for third-party fees unless stated otherwise.

13) Confidentiality

Each party may receive non-public information from the other (“Confidential Information”). Each party agrees to protect Confidential Information and use it only for purposes of providing or receiving the Services, except where disclosure is required by law.

14) Prohibited use

You agree not to:

  • Use the Services for unlawful, deceptive, or fraudulent activity
  • Submit false claims, misleading ads, fake reviews, or misrepresent your location/services
  • Violate ad platform policies or applicable professional/medical advertising rules
  • Attempt unauthorized access, interfere with security, or introduce malicious code

We may suspend or terminate access if we believe you violated these Terms or applicable laws/policies.

15) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or that defects will be corrected immediately.

16) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOCTOR WEBSITE AND BETTER WIKI LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICES IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

(Some jurisdictions do not allow certain limitations, so some of the above may not apply.)

17) Indemnification

You agree to defend, indemnify, and hold harmless Better Wiki LLC and its owners, contractors, and affiliates from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from:

  • Your ads, content, claims, or services
  • Your violation of platform policies, laws, or third-party rights
  • Your breach of these Terms or misuse of the Services

18) Suspension and termination

We may suspend or terminate Services if you fail to pay fees when due, violate these Terms, or create legal/security risk.

Upon termination:

  • You must stop using any Doctor Website IP except paid deliverables you are licensed to use
  • You remain responsible for fees incurred up to the termination effective date

Sections that by their nature should survive termination (including payments due, IP, confidentiality, disclaimers, limitation of liability, indemnification, governing law) will survive.

19) U.S. state privacy “Do Not Sell or Share” notice (ad tracking)

We do not sell personal information for money. However, some advertising partners may consider certain data sharing (such as via cookies/pixels used for interest-based advertising) to be a “sale” or “sharing” under some U.S. state privacy laws. Where applicable, you may opt out by adjusting cookie settings on our site (if available) and/or using browser or platform privacy controls.

20) Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new Effective Date. Continued use of the Services after changes become effective means you accept the updated Terms.

21) Governing law and venue (Delaware)

Governing law. These Terms (and any dispute or claim arising out of or relating to these Terms or the Services) are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules.
Venue. Any legal action or proceeding arising out of or relating to these Terms or the Services must be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

22) Miscellaneous

  • Entire agreement: These Terms and any SOW are the entire agreement regarding the Services.
  • Severability: If any provision is unenforceable, the rest remains in effect.
  • No waiver: Failure to enforce a provision is not a waiver.
  • Assignment: You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or asset sale.
